Wilensky & Jones assists clients throughout the U.S. with section 1031 tax deferred real estate exchanges. Real estate owners and real estate investors know that section 1031 of the IRS Code permits tax free and qualified intermediary exchanges of like kind property.
A 1031 exchange of real estate can be complex, and there are strict requirements that must be observed. Some of the issues that our attorneys can assist in resolving, and providing experienced advice, include the following:
- Characterization of qualified property (advising whether the real estate in question is like-kind property)
- Timing issues (timing regarding identifying your replacement property and timing regarding closing on the new property)
- Qualified properties (advising clients on whether their property or the property they seek to acquire qualifies for a 1031 exchange)
- Tax issues (advising on tax exchanges or limiting tax liability in a real estate exchange)
We understand the importance of competent representation and timely, cost-effective advice when it comes to transacting a 1031 exchange of real property. Clients exchanging restaurant properties, commercial real estate, rental properties, apartment complexes and other real estate call upon our services for our ability to provide sound advice and skilled representation throughout the real estate transaction.
